These Terms of Service ("Terms") are a legal agreement between you and CreditWell LLC, a Georgia limited liability company ("CreditWell," "we," "our," or "us"). They govern your use of thecreditwell.com (the "Site") and any services we provide to you. By using the Site, submitting a consultation request, or signing a service agreement with us, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site or our services.
CreditWell is a credit repair organization as defined under the federal Credit Repair Organizations Act (CROA), 15 U.S.C. § 1679 et seq. We help individuals work on their credit reports by reviewing the information on file, identifying questionable items, and disputing or addressing those items with credit bureaus, creditors, and other furnishers of information on the client's behalf. We also provide credit education, financial coaching, and — separately — referrals to third-party lending partners.
The exact scope of services we provide to any specific customer is set out in a separate written service agreement executed at the time the customer engages our services.
You must be at least 18 years old and a resident of the United States to use our services. By submitting a consultation request or engaging us, you represent that you meet these requirements and that the information you provide is true and accurate.
When you submit our consultation form or otherwise provide your contact information, you consent to receive communications from CreditWell by email, telephone, and text message (SMS) at the numbers and addresses you provide. These communications may include service-related messages such as scheduling, follow-ups, and account updates, as well as occasional service announcements and promotional information where you have opted in.
Message frequency varies. Message and data rates may apply. You may opt out of SMS messages at any time by replying STOP, and you may request help by replying HELP. See our Privacy Policy for more information about how we handle SMS opt-in data.
Federal law provides important protections to consumers who work with credit repair organizations. As required by CROA, you have the following rights:
Before you sign a service agreement with CreditWell, we will provide you with a written disclosure titled "Consumer Credit File Rights Under State and Federal Law" that summarizes these and other rights in greater detail. You acknowledge receipt of these Terms and that disclosure as part of any service agreement you enter into with us.
CreditWell does not charge customers for services before those services have been performed. In compliance with CROA, our service agreements are structured so that you pay for credit repair services after the work is performed, not before.
The exact fees, billing cycle, and payment method applicable to your engagement are set out in your written service agreement. You authorize us (and our payment processor) to charge the payment method on file according to the schedule set out in that agreement.
You may cancel your service agreement with CreditWell at any time. As required by CROA, you may cancel within three business days of signing for any reason and receive a full refund of any amounts paid. After that initial three-day period, your service agreement will set out the procedure for cancellation and any applicable timing for billing of work already performed. CreditWell does not collect fees for services that have not yet been performed.
CreditWell is not a lender. We do not originate, underwrite, fund, or service loans of any kind. We help our customers work on their credit and may, with the customer's consent, introduce them to third-party lending partners — including mortgage, auto, business, and personal lenders — whose products may be appropriate for the customer's goals.
CreditWell may receive compensation from lending partners when a referred customer's loan is funded. This compensation does not change the rate, terms, or cost of any loan to the customer. Customers are always free to apply for credit through any lender of their choosing and are under no obligation to use a CreditWell-referred lender. Customers should review and compare all loan offers carefully before making a decision and should consult with a qualified financial advisor when appropriate.

All content on the Site — including text, graphics, logos, photos, and software — is owned by or licensed to CreditWell and is protected by copyright, trademark, and other intellectual-property laws. You may view and use the Site for your personal, non-commercial use only. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written permission.
CreditWell does not guarantee any specific credit score increase, the removal of any particular item from your credit report, approval for any loan, or any other specific outcome. Results vary based on each individual's credit history, the accuracy of the information on file, the response of credit bureaus and creditors, and other factors outside our control. Information on the Site is provided for general informational purposes and is not legal, tax, or financial advice. You should consult a qualified professional for advice tailored to your situation.
The Site and our services are provided "as is" and "as available." To the maximum extent permitted by law, CreditWell disclaims all warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, CreditWell and its members, managers, officers, employees, agents, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site or our services. CreditWell's total liability for any claim arising out of these Terms or your use of our services will not exceed the amount you actually paid us in the twelve months preceding the event giving rise to the claim. This section does not limit any liability that cannot be limited under applicable law, including rights provided to you under CROA.
You agree to defend, indemnify, and hold harmless CreditWell from any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) information you provided to us that turns out to be inaccurate or fraudulent, or (c) your violation of any law in connection with your use of the Site or our services.
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site or our services will be resolved exclusively in the state or federal courts located in Gwinnett County, Georgia, and you consent to the jurisdiction of those courts. Nothing in this section limits any rights you have under CROA or other applicable consumer-protection laws.
We may update these Terms from time to time. When we do, we will revise the "Effective" date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Site or our services after the changes take effect constitutes your acceptance of the updated Terms.
